1) The plain-English, common-sense part

SPAM

You won't get any because of us, period. Visionary Tennis won't sell, trade, or lend your personal information. You'll get some occasional email from us (see below), but we won't be schlepping diet pills or mortgage rates — what little (and we do mean little) correspondance you get from us will always be relevant to sports.

LEGITIMATE EMAIL

By this we mean email that we send (which will always come from a visionarytennis.com address) that is necessary for your proper participation in your league. Reminders to check your upcoming matches, approaching deadlines, info about your account, etc — normal stuff.

CONTACT FROM OTHERS

Other players will be able to see your email address and phone number(s) — they have to in order to be able to contact you, of course. But they won't be able to see things like where you live or how old you are. Visitors to the site (ie people who haven't signed up yet) will be able to email you as well — but only by using a special mailing form within the website. They will not see your address unless you choose to reply to their email.

You are assigned an identification number and select a password-both are needed to enter the Site and to access your Player Profile. At registration, players must also provide credit card information, which is used only to process payment of the registration fee and, generally, is not retained on our Site.

If we do correlate any Aggregate Information to you, it will be protected like any other Personally Identifiable Information under this Privacy Statement.

SHARING YOUR INFORMATION

Except as disclosed in this Privacy Statement, we do not sell, trade, rent, or otherwise retransmit any Personally Identifiable Information we collect online unless we have your permission. Any Personally Identifiable Information you provide to us will be stored in Visionary Tennis databases.

Your permission is always secured first. We will not use or share the Personally Identifiable Information collected on our Site in ways unrelated to the purpose for which you provided the information, including those described above, without providing you a choice whether to permit any such unrelated uses.

CHILDREN’S PRIVACY PROTECTION

We take special care to protect the privacy needs of children under the age of 13 and encourage parents to be an active participant in their child's online activities. We abide by the requirements of the Children's Online Privacy Protection Act (COPPA) and other relevant laws. Our Site does not target and is not intended for children under the age of 13, and we will not knowingly collect Personally Identifiable Information from them. If we discover personal data from a child through our Site, we will eliminate that data.

Liability and Assumption of Risks

You agree with the following statement: “I am aware that participating in the activities and sports, without limitation, offered by or associated with Visionary Tennis, exposes me to many inherent risks, dangers and hazards. By engaging in any activities offered by or associated with Visionary Tennis, I freely accept and fully assume all inherent risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting therefrom.”

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

In consideration of Visionary Tennis permitting you to participate in its activities and sports, you hereby agree as follows:

1) to waive any and all claims that you have or may in the future have against Visionary Tennis, its directors, officers, employees, agents, representatives, assigns and successors;

2) to release Visionary Tennis, its directors, officers, employees, agents, representatives, assigns and successors from any and all liability for any loss, damage, injury or expense that you may suffer or that your next of kin may suffer, as a result of your participation in activities and sports offered by Visionary Tennis, due to any cause whatsoever including negligence, breach of contract, or breach of statutory duty of care on the part of Visionary Tennis, its directors, officers, employees, agents, representatives, assigns and successors;

3) to hold harmless and indemnify Visionary Tennis, its directors, officers, employees, agents, representatives, assignees and successors from any and all liability for any property damage or personal injury to any third party, resulting from your activities and your participation in the activities offered by or associated with Visionary Tennis;

4) that this Agreement shall be effecting and binding upon any heirs, next of kin, executors, administrators and assignees in the event of your death;

5) that you have read and understood this Agreement prior to registering for Visionary Tennis Leagues. You are aware that by registering to become a member of Visionary Tennis Leagues, you are waiving certain legal rights which you or any heirs, next of kin, executors, administrators and assignees may have against Visionary Tennis, its directors, officers, employees, agents, representatives, assigns and successors.

Other

Visionary Tennis, its directors, officers, employees, agents, representatives, assigns and successors may, from time to time, make audiovisual recordings (ie photographs, video, etc.) of any of its events, whether directly or indirectly administered by Visionary Tennis. You agree, by your participation in or attendence at any such events, to permit without qualification any such audiovisual recordings to be used for any and all promotional purposes that Visionary Tennis may see fit, and without compensation.

CHANGES TO THIS STATEMENT

Any updates or changes to the terms of this Privacy Statement will be posted here on our Site and the date of the newest version posted below. Please check back frequently, especially before you submit any Personally Identifiable Information at our Site, to see if this Privacy Statement has changed.
